These Terms of Service (“Terms”) govern your access to and use of our websites, listings, forms, emails, SMS/MMS programs, and other services (collectively, the “Services”). By using the Services, you agree to these Terms and our Privacy Policy

You must be 18 years or older (or the age of majority in your jurisdiction).
If you create an account or submit a listing, you are responsible for maintaining its confidentiality and for all activity under it.
You agree to provide accurate and complete information when creating an account or submitting a property inquiry.
You agree not to:
(a) violate laws or regulations (including real estate advertising and fair housing laws),
(b) infringe or misappropriate third-party rights,
(c) interfere with the security, integrity, or availability of the Services,
(d) use automated tools or scraping methods without permission, or
(e) post, upload, or transmit unlawful, misleading, or harmful content, including false property data.
All site content, branding, listings, text, graphics, and materials are owned by Houses by Zipcode or its licensors and protected by intellectual property laws.
We grant you a limited, non-exclusive, revocable license to access and use the Services for personal or business use related to buying, selling, or marketing real estate through our platform.
Do not copy, scrape, or redistribute content without permission.
If you submit feedback, suggestions, or testimonials, you grant us a perpetual, worldwide, royalty-free license to use, reproduce, and display them without obligation or compensation.
Content and tools provided through the Services are for informational and marketing purposes only.
We are not a licensed real estate brokerage or agent and do not provide legal, financial, or tax advice.
Any property valuations, savings calculators, or comparisons are for general informational purposes and should not be relied upon as professional advice.
If you purchase a listing plan or related service:
All fees, terms, and deliverables are disclosed at checkout or in an order confirmation.
Payments are securely processed via Stripe.
Fees are non-cancelable and non-refundable once the service has begun, except as required by law.
You authorize us (and our payment processor) to charge your provided payment method for applicable fees.
We may link to or integrate third-party platforms, such as MLS/IDX data feeds, analytics, or payment processors.
These are governed by their own terms and privacy policies, and we are not responsible for their content or practices.
By opting in, you agree to the program terms below. You may receive SMS/MMS from our 10DLC number(s).
Program name: Houses by Zipcode
Purpose: Transactional and/or marketing messages (depending on your opt-in).
Opt-in methods:
Checking an unchecked box on our web forms labeled for text consent and submitting your number; and/or
Texting a keyword we provide (e.g., JOIN, START); and/or
Completing a digital or paper form where you explicitly consent to texts.
Double opt-in: For marketing, we may confirm by asking you to reply YES.
Message frequency: Varies; messages may be recurring.

Carriers: Carriers are not liable for delayed or undelivered messages.
Eligibility: 18+. Do not send sensitive information via text.
Data handling: We maintain records of your opt-in/opt-out status, number, and message metadata as required for program operation and compliance.

By using the Services, you consent to receive communications electronically (including emails and texts) and to sign or accept agreements electronically, consistent with the E-SIGN Act and other applicable laws.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that property listings or content will be accurate, complete, uninterrupted, secure, or error-free, nor that results (such as exposure or inquiries) are guaranteed.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL HOUSES BY ZIPCODE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.
OUR AGGREGATE LIABILITY WILL NOT EXCEED $100 OR THE AMOUNT YOU PAID US FOR THE SERVICES IN THE THREE MONTHS PRIOR TO THE CLAIM, WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations; portions of this section may not apply to you.
You agree to defend, indemnify, and hold harmless Houses by Zipcode and its affiliates, officers, and employees from any claims, damages, liabilities, or expenses (including reasonable attorneys’ fees) arising from:
your misuse of the Services,
violation of these Terms, or
infringement or violation of third-party rights.
We may suspend or terminate access to the Services at any time, with or without notice, for any reason, including suspected violation of these Terms.
Provisions that by their nature should survive (e.g., intellectual property, disclaimers, limitations of liability) will survive termination.
These Terms are governed by the laws of the State of Florida, without regard to conflicts of laws.
Informal resolution: If a dispute arises, email info@housesbyzipcode.com
and we’ll try to resolve it within 30 days.
Arbitration & class-action waiver: If not resolved, disputes will be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Rules in Pinellas County, Florida, in English, before a single arbitrator.
No class actions or class arbitration. Either party may bring an individual claim in small-claims court instead.
Opt-out: You may opt out of arbitration within 30 days of accepting these Terms by emailing info@housesbyzipcode.com
with subject “Arbitration Opt-Out,” your full name, and the email/phone associated with your use.
We may modify the Services or these Terms at any time.
If changes are material, we will provide reasonable notice (e.g., posting the revised date).
Continued use after changes means you accept the updated Terms.
Severability: If any provision is unenforceable, the remaining provisions remain in effect.
Assignment: You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement regarding your use of the Services.
